Agreeing to these terms
These terms are an agreement between you and BBQ Trail Guide (“we,” “us”), based in Tennessee, USA, covering bbqtrailguide.com, our newsletter, and our listing and Featured services. By using the site, subscribing, submitting a listing, or buying a Featured listing, you agree to these terms and our Privacy Policy. If you’re acting for a business, you confirm you’re authorized to bind it.
Using the site
You may use the site for your personal, non-commercial trip planning. Please don’t misuse it: no breaking or overloading it, probing for vulnerabilities, scraping it in bulk in a way that burdens it, submitting false or someone else’s information, or using it to break the law.
Our guides
Our guides are for general information. We build them from published sources (press, polls, oral histories and pitmasters’ own words) and link each fact to where it came from. We don’t publish our own scores. Restaurants change hours, prices, menus and locations, and they close, sometimes without notice. We don’t guarantee that hours, prices, menus or other details are current or complete. Call ahead before you drive. Links to other sites are for your convenience; we don’t control and aren’t responsible for them.
Featured listings
A basic listing is free. Featured is a paid partner listing subscription that gives a business a labeled partner spot and extras described on the Featured page. Partner listings are paid, are labeled as such, and are shown apart from the spots guides include. Paying doesn’t get a spot into a guide, change its position, or change the facts in our guides, what sources say, or which spots our guides recommend.
Prices, in US dollars:
- Founding: $29 per month, available to the first 20 owners who subscribe. The Founding price stays locked in for as long as that subscription remains active.
- Monthly: $49 per month after Founding spots are gone.
- Yearly: $490 per year.
Applicable taxes may be added. We may change prices for future periods with advance notice by email; a change takes effect at your next renewal after the notice, and you can cancel before then.
Billing, renewal and cancellation
- Auto-renewal. Your subscription renews automatically at the end of each monthly or yearly period, and Stripe charges the payment method on file, until you cancel.
- Cancel anytime through the Stripe billing portal (linked from your checkout confirmation page) or by emailing hello@bbqtrailguide.com. Cancellation takes effect at the end of the current paid period, and Featured placement continues until then.
- No refunds for partial periods, unless required by law.
- Failed payments. If a renewal payment fails and isn’t fixed, we may pause or end Featured placement. Your free basic listing isn’t affected.
- Payments are processed by Stripe and subject to Stripe’s terms.
Content you submit
When you submit a listing, interview answers, links or other material (“your content”), you keep ownership of it. You grant us a non-exclusive, royalty-free, worldwide license to use, edit lightly for length and clarity, format, display and publish your content, with your name and business name, on bbqtrailguide.com, in our newsletter and on our social accounts, in connection with your listing and promoting the guide. You warrant that your content is accurate, that you have the right to submit it, and that it doesn’t infringe anyone’s rights or break the law. Tell us promptly if something changes so we can update it.
Photos
Only upload photos you own or have permission to share. When you upload photos and confirm the permission box on the claim form, you grant the license shown there: a non-exclusive, royalty-free, worldwide license to display, resize and crop them on bbqtrailguide.com, in our newsletter and on our social accounts to promote your business, with credit to your business. You can withdraw that permission anytime by emailing us, and we’ll remove the photos within 14 days.
Listings we may refuse or remove
We decide what to publish. We may decline, edit for accuracy, or remove any listing, content or photo, and may decline or end a Featured subscription, for example if information is inaccurate, a business has closed, content infringes rights, or these terms are broken. If we end a paid Featured subscription for reasons other than a breach of these terms, we’ll refund the unused portion of the current period.
Our content
The site’s design, text, maps, logos and the BBQ Trail Guide name belong to us or our licensors. You may share links and quote short excerpts with credit, and print the free trail map for personal use. Don’t otherwise copy, republish or sell our content without permission. Third-party names, quotes and embedded videos belong to their owners.
Disclaimers
The site and services are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t guarantee any particular amount of traffic, customers or results from a listing or Featured placement. We aren’t responsible for the food, service, safety or conduct of any restaurant, or for your travel.
Limitation of liability
To the fullest extent the law allows, BBQ Trail Guide won’t be liable for any indirect, incidental, special, consequential or punitive damages, or lost profits or data, arising from your use of the site or services. Our total liability for any claim related to the site or services is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Some places don’t allow these limits, so they may not fully apply to you.
Indemnity
If you submit content or buy a Featured listing, you agree to cover reasonable losses and costs we incur from third-party claims that your content infringes their rights or that you broke these terms.
Governing law
These terms are governed by the laws of the State of Tennessee and applicable US federal law, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Tennessee, and you and we consent to their jurisdiction.
Changes
We may update these terms. We’ll post the new version here with a new “Last updated” date, and give notice by email to Featured subscribers for material changes. Continuing to use the site or keeping a subscription after changes take effect means you accept them. If these terms and the claim form’s permission text differ, the form text applies to the photos and answers you submitted with it.
